Is this business legal?Since its inception the company has ensured that the business complied in every respect with all the applicable South African laws. We have given copies of our business plan to the South African Reserve Bank and the Department of Trade and Industry (DTI) and have not received any indications of disapproval from either party. The DTI's Consumer Affairs Committee (CAFCOM) undertook an informal investigation into the company and concluded that no formal investigation into the company was necessary, which it confirmed in writing. The company's legality is accordingly not, to our knowledge, in question as far as any government institutions concerned with network marketing and charitable donations are concerned. |
Is the company a member of the Direct Selling Association (DSA)?No, the company decided not to join the DSA, as the DSA is a private association regulating networks that involve direct selling of products. Since the company offers a service rather than products it would be pointless to join the DSA. |
Is this a pyramid scheme?No. Pyramid schemes are illegal. The company is a legally constituted, equal opportunity business operating on a fully legal network marketing structure. Network marketing is recognised as a legitimate form of business all over the world, including South Africa. |
Can I cancel my application to join the company after my application form has been submitted, or am I tied into a contract?There is a 30-day "cooling-off" period, as required by law. Should you cancel within 30 days of having joined, any payments made by you will be refunded. Thereafter you may cancel at any time by giving 30 days' written notice. No refunds will, however, be paid in such an event (i.e. after the above-mentioned initial 30-day period). |
If I cancel, can I rejoin?You may rejoin, with the written permission of the company, after three months of canceling. |
How do I know the company won't fold, and if it does, what will happen to my group?As long as there are groups in place the plan will continue. If by a majority decision of the remaining members it is decided to cease operations, the remaining funds (after all outstanding liabilities are met, including outstanding commissions) will be distributed to charitable institutions in the Company's books. |
How do I know who is in my group?You will have the option of having your group's details posted, faxed or e-mailed to you. If you have internet access, you will be able to look up your complete group's details on the company website at any time. |
Where do I find people with whom to build my business?You make a list of all the people you know or are acquainted with. This is your prospect list. Do not leave any names off this list. You will be surprised at how many names you can find. Remember that initially you are looking for only 6 to 10 people, and then you help them find their 6 to 10 people, etc. |
Are we allowed to advertise and print our own marketing material using the company's name and logo?Yes, on condition that you first obtain approval of your material and wording from the company after submitting full details of your proposals. You are an Authorized Independent Representative (A.I.R.) of the company and may also, therefore, use all the official marketing material supplied by the Company. |
What if I like the business but don't have the time to build it?This business is based on the principle of helping others to help themselves. Your introducer is there to help you. The time you need to get your business up and running is totally dependent on how quickly you want it to grow. You may also choose simply to continue donating to charity through our membership plan if you like the overall concept. |
Can I have more than one DMP number?No, only one DMP number is allocated per person or company/organisation. |
Can I take people from other members' groups if their introducers are not supporting them?No. Action will be taken against any member found doing this (see the Rules and Regulations on the back of the application form). However, if you are in a situation where your introducer is not providing any support, you may request permission in writing from the company to move into another group. Provided you have no members in your group and you and your introducer have not rectified the situation within 30 days of receipt of relevant correspondence from the Company, the Company may then, at its discretion, allow the move. All moves applied for will be judged on individual merit. |
Do I earn any commission if I don't have three people on my 1st level but more than three on my other levels?You won't earn any commission. You must have three or more fully paid-up members on your 1st level in order to earn any commission. At any time that this minimum is not met, commission will not be earned. |
What happens if I have three or more people on my 1st level, two on my 2nd level and more than three on my 3rd and 4th levels?You will not earn any commission on level 2, 3 or 4. In order to earn commission on a particular level and below, you must have at least one commission earner on each of levels 1, 2 and 3 |
How long do I continue to get commission?For as long as you have paid-up members and the correct structure in your group as explained above. |
Will my contribution increase annually?There is a voluntary option for an annual escalation of your contribution. It would be in your interest to encourage all your members to exercise this option. |
Are there any bonuses, and if so, how do I qualify for them?There are several incentive bonuses. Some are once-off and others may remain in place as long as the qualifying conditions of the bonus are met. |
Can the bonuses be altered or taken away?Bonuses may, from time to time, be altered, added or taken away, but the company will always endeavor not to prejudice its members in any way once they have qualified for a particular bonus. |
Can a close corporation or Pty Ltd join as a member?Yes, at the discretion of management, provided all the relevant documentation has been received and all conditions have been met. There can be only one DMP number per organisation and no member or director of such an organisation may already be an individual member of the company. |
Can a registered non-profit organisation (NPO or NGO) join the company?Certainly. It is hoped, in fact, that such organisations will see this as a very successful and effective way of generating funds and building a sustainable stream of income for themselves. |
Is any capital outlay required for me to join?No, but members are strongly encouraged to purchase the optional starter pack, which includes the manual, a presentation DVD and other presentation material, and a few application forms - all essential if you want to start off on a strong footing and establish a successful business, just as any tradesman or professional needs manuals, guidelines and the correct tools and equipment to do his or her job correctly and efficiently. |
What is the best way to grow my business? By going wide as quickly as possible or by building deep?Width will encourage growth and income. Go wide, and at the same time encourage those on your first level to do the same. In this way depth will begin to take care of itself. |
I want to do the business, but I can't do presentations. Who can do the presentations for me?Firstly, the presentation DVD is an excellent tool to do the talking for you. Secondly, your introducer will help you with one-on-one presentations and home meetings. Wherever possible, the Company will also set up regional presentations to which you may take or refer prospective members. |
What happens if I relocate overseas?Your business will continue to operate and commissions due to you will be paid, as long as you have a South African bank account and your members pay their contributions. All the necessary day-to-day administration will continue to be done by the Company. You can monitor your business via the internet from anywhere in the world. |
Will commissions and/or percentages paid to charities ever be reduced?No, on the contrary, it is hoped that they will increase as the Company grows. |
How do I check the transparency of the Company and know that the stated amounts / donation percentages are being paid to the relevant charities?Reconciliations of the company and the Charity Distribution Fund bank accounts are published monthly. A quarterly auditors' report is available to all members via the internet or on request from Head Office. A list of all charities that have received funds, with details of both their current amounts and totals received, is published every month. |
What happens if my debit order fails?You will have up to the 12th of the month to make an alternative arrangement for payment. If your payment is not made within this period, your commission will be suspended until payment is resumed. Missed commissions will be forfeited. If no payment is received for two consecutive months, your membership will automatically be terminated. NB: Debit orders are processed on the last working day of the month. |
What happens if someone in my group fails to pay or cancels?You will lose only the commission from that member. The remainder of your group will remain in place. (But see the earlier questions and answers relating to conditions of commission payments on the various levels in your group.) |
What is the purpose of the "Non-payments" statement?The Non Payments or Unpaid statement provides you with details of members who have not paid their contributions, whatever the reason, and thereby gives you the opportunity to contact them and encourage them to get up to date with their payments. In this way you can help ensure that you do not lose out on commissions and bonuses. |
How do I run my business and grow my group?Consult with and use your introducer. Study and use your manual. Attend regular regional training and motivational meetings. Look at your Hierarchy Report regularly and stay positive by being around motivated people. Avoid negative people. |
Can other members see my hierarchy?Only your introducer can see your hierarchy, and then only those details that coincide with yours down to his or her 4th level. |
What qualifications do I need?No formal academic or similar qualifications are needed. If you are under the age of 18 you must have a legal guardian's written permission to join the company and have an ID number and a debitable bank account, both for payment of contributions and for the receipt of commissions and bonuses. |
Can I sell, transfer or bequeath my business?Yes. For a transfer you will need the authorisation of the Company to do so, but permission will not be unreasonably withheld. Management would hope that the person taking over the business would want to continue to grow the business, a bequeathed business will simply he handed over to the beneficiary of choice stated on the application form. |
When will I start earning commissions and bonuses?If your group structure is in place and all the relevant members are paid up (by the 1st of the month), you will be paid your commissions and bonuses on or about the 20th of that month. |
How do I get paid?As close to the 20th of the month as possible, by electronic transfer into the same account from which your contribution is drawn. If your commission is more than your contribution, then the contribution amount will be deducted from the commission due to you. |
How are the funds that are allocated for charities distributed?On your application form you can indicate your preferred charity. Once that charity has 20 or more active (i.e. paid-up) members that have nominated it as their preferred charity, it starts receiving funds, provided it a registered NPO and has given The company and its representatives the necessary authorisation to generate funds on its behalf, for remuneration, as per The company's terms and conditions. |
Am I employed by the company and do I have to pay tax?No, you are not employed by the company. You are an Authorized Independent Representative (A.I.R.) and run your own business independently of the company. The company merely assists you through its administrative and other relevant infrastructure. As in the case of any other business it is your responsibility to declare all your income. The company will issue you with the relevant IT3 (a) form. |
Can I build someone else's group for them?Yes, but you may not ask for, or accept, any remuneration for it. If the member is within your group then you will be compensated via normal commission, if the member is outside your earning group then you may not ask for, or accept, any remuneration for it. |
